The Reef Resort Owners Association became incorporated on 28 March 2023. The association came about after irregularities occured during the Stage 1 2022 Annual General Meeting (AGM).
An owner submitted an Adjudication Application which was accepted by the Commissioner for Body Corporate and Community Management (BCCM).

The application was dismissed on 17 November 2023 but not before the irregularities of the AGM were acknowledged and the election of the committee considered invalid by the Adjudicator.
The Adjudicator hoped the committee election processes will be resolved soon. Adjudication Orders
Concerns have been held for more than six years into how the resort and the ownership of villas has changed.
Villa ownership has gone from almost all holiday letting being run from a letting pool to Air BnB, long term tenants, villas being bought to house tourism industry staff and resident owners. The three stages have gone their own way, stage 3 in 2021 and stage 2 in 2022/3. Teleconferencing has become the norm and it is rare to see the Caretaker on site.
2024, the stage 1 committee now has 3 resident members. The executive committee have not asked for payment for service since 2022 and travel allowance is no longer granted to interstate committee members.
How far have we come in stage 1?
In the beginning the association had 3 main goals. Association members have achieved 2 of them and we thought we were well on the way to fixing the third:
We wanted to save money by not paying fees of up to $28,300.00 to the executive committee of stage 1 and that happened.
This now includes travel expenses; "committee members are no longer authorised to seek reimbursement of their reasonable travel costs and expenses for attending body corporate meeting." (sic)
We wanted more resident representation on the stage 1 BC committee which has also happened.
The third and what we thought was the biggest one is the gardens.
Minutes of the 2024 AGM held on 4 November. You can see all the motions concerning gardening carried (12, 14, 15, 17, & 20). The Body Corporate has spoken and it was expected that problem will also be fixed.

UPDATE 28 November 2024.
The stage 1 AGM minutes were distributed to owners on 7 November 2024.
It is clear that the BC committee is to meet once per calendar month from now on. That being so, the first meeting should be before 30 November and owners should be notified 7 days before making it, 23 November at the latest for the Notice of Committee Meeting. Owners can attend the meeting as observers provided they ask the secretary at least 24 hours before.
It would be expected that the lawful decisions of the body corporate (owners motions that carried) would be dealt with as they must under Section 101 (2) of the BCCM Act.

UPDATE 13 December 2024
The stage 1 BC committee sent out a memo on 13 December concerning the module change, stating:
"We haveresolved therefore to not implement this resolution and do everything in our power to prevent it going through. Other resolutions that we believe are not in the interest of owners are alsounder review."
This is serious, the resolution mentioned here is the change of module from Commercial to Standard wich was carried by special resolution at the AGM. The Titles Office place a time limit of 3 months to have this done, meaning if it has not occured by 4 February then it will not be allowed.

UPDATE 6 January 2025
The RROA President contacted the Stage 1 Strata Manager asking him to lodge the module change. He declined because he only takes instructions from the Chairperson.

UPDATE 11 January 2025
Appeal to lot owners to hold an Extraordinary General Meeting (EGM).
For lot owners to call an EGM it requires 25% of them ask for an EGM.

UPDATE 19 January 2025
With more than the required 25% of owners asking for it, 36% actually, the request for an EGM has been sent to the BC secretary, via Archers today, 19 January 2025.
The purpose of the EGM is to replace the executive committee because they are in breach of the BCCM Act by not carrying out the lawful decisions of the Body Corporate. BCCM Act Section 101 (2) refers.
We can expect an EGM to be called any time now.

UPDATE 31 January 2025
It looks like an EGM will be called but not by the 36% of lot owners who have called for it. It has stalled.
Instead it looks like the BC committee will be calling an EGM.

UPDATE 1 March 2025
It looks like the owners will get their way after all by physically signing the letters to the secretary requesting an EGM.
An EGM will most likely take place this month.
